Reports in the local media suggest that the Supreme Court has granted a stay of execution over the ruling of Alban Sumana Bagbin.
The Apex Court of the land has asked Parliament to reinstate the four Members of Parliament whose seats were declared vacant by the Speaker of Parliament.
The stay of execution prevents Parliament from implementing the ruling of the Speaker on October 18, 2024.
A five-member Supreme Court panel presided over by the Chief Justice directed that the decision to declare the seat be stayed and not implemented.
Ruling on the matter on Thursday, October 18, 2024, Speaker Bagbin said, Honourable members it is important to point that the speaker is called upon by the standing orders of parliament particularly order 18 to inform the house of the occurrence of a vacancy of the seat of a member under clause (1) b to e, g and h of article 97 of the constitution. Accordingly, I will proceed to inform the house that by the notification of the polls the following MPs are by their actions vacated their seats in parliament.”
The affected Members of Parliament affected include:
1. Cynthia Morrison, the current NPP MP for Agona West constituency in the Central Region, who has filed to run as an independent candidate.
2. Kwadwo Asante, the current NPP MP for the Suhum constituency in the Eastern Region, who has also filed to run as an independent candidate.
3. Andrew Asiamah Amoako, currently an independent MP for the Fomena constituency in the Ashanti Region, who has filed to run in the upcoming election as a candidate for the ruling New Patriotic Party (NPP).
4. Peter Kwakye Ackah (Amenfi Central) who has decided to contest as an Independent Candidate.
