The Food and Drugs Authority (FDA) has announced that it will appeal the decision of the High Court in the case between it and Tobinco Pharmaceuticals.
According to the authority, it does not agree with the court’s decision hence its decision.
It, however, clarified that there was no negligence on the part of the current Chief Executive, who has since the initiation of the case ensured that the Authority responds.
The statement from the FDA clarified that the issues between it and Tobincco dates back to 2013 when Stephen Opuni was the Chief Executive of the FDA.

Elder Dr. Samuel Amo Tobbin, the Chief Executive Officer of Tobinco Pharmaceuticals Limited has welcomed a court ruling, which completely exonerates him from allegations of importing fake drugs into the country.
An Accra High Court presided over by her Ladyship, Audrey Kocuvie-Tay, has ruled that Tobinco Pharmaceuticals Limited (TPL) and its group chairman, Elder Dr. Samuel Amo Tobbin, never imported fake drugs into the country.
This follows claims by former Food and Drugs Authority (FDA) Chief Executive Officer, Dr. Stephen Kwabena Opuni, that Tobinco had imported fake drugs into the country.
In a brief statement, the renowned businessman said the ruling vindicates his position that his company never imported substandard drugs (fake drugs) into the country adding, “Tobinco Pharmaceuticals has always produced and marketed its drugs professionally to its valued Ghanaian and African customers, so it will never endanger their health.
“It is a positive feeling and welcome news for a court of competent jurisdiction to affirm my innocence. It’s a very great feeling!” CEO of the Tobinco Group said
“The company takes this opportunity to thank all Ghanaians for their prayers and support during the crisis and wishes them well. Tobinco will continue to produce quality drugs and other medical supplies to promote quality healthcare,” the statement said.
