Bagbin to annulled Parliamentary candidates results: Until you are sworn-in by the Speaker you remain MP-elect

The Speaker of Parliament Alban Bagbin has made it clear that MPs whose election results were declared invalid by the Supreme Court on Friday, 27 December 2024, are not eligible to take the oath of office on 7 January 2025.

Citing anomalies in the recollation process, the Supreme Court declared the recollated results for the constituencies of Okaikwei Central, Ablekuma North, Tema Central, and Techiman South invalid.

The National Democratic Congress (NDC) filed a lawsuit challenging a High Court order directing the Electoral Commission (EC) to recollect the results of parliamentary elections in nine contested constituencies. The ruling addressed this challenge.

The NDC contended that the recollection procedure was illegal and went beyond the High Court’s authority, compromising the legitimacy and transparency of the election.

Speaking in Parliament on Saturday, 28 December, Speaker Bagbin said that candidates whose results were annulled by the court could not assume office without proper legal backing.

“The decision of the Supreme Court just followed the position I took before they even delivered their decision,” Bagbin stated. “To become a Member of Parliament, you have to be elected by voters, declared by the Electoral Commission, and sworn in by the Speaker. Until you are sworn in, you remain MP-elect.”

“They were unknown to the law and not properly so-called MPs-elect,” he said. “I’m the gatekeeper. The right thing must be done for us to be able to reset Ghana.”
