There’s no supremacy of the Judiciary – Beatrice Annan

The spokesperson for the John Dramani Mahama campaign team, Beatrice Annan has argued that the Chief Justice Gertrude Torkonoo is not a supreme body.

During a panel discussion on Metro TV monitored by MyNewsGh.com, Beatrice Annan argued that the Chief Justice, Gertrude Torkonoo failed to compel the speaker to recall parliament

“There is nothing like the superiority of the judiciary. The constitution is Supreme. The intent of Democracy and constitutionalism is that you have to rule according to the constitution. So your force of power is from the constitution. That is why when the constitution instructs that you elect a majority from parliament”, Beatrice Annan argued her point.

While citing an example to back her point, Beatrice Annan stated that if the fact that the president has the power to appoint does not make him supreme but rather derives that power to appoint from the constitution, hence the Supreme Court is not Supreme.

“We know the superiority of the Supreme Court and not the judiciary. So why didn’t the Chief Justice compel the Speaker to go back to parliament?” she questioned. 

According to her, the constitution doesn’t give the Chief Justice the power to do so because she has no power to call parliament to go back.

“If she comes out with a verdict she will say that by some magical interpretation, these people haven’t vacated their seats so they are still members of parliament. What can she do beyond that? What can she do? She can only declare what the constitution says, After that what can she do? She can’t do anything about it” Beatrice stated.
