Labadi Beach Hotel obtains court injunction against Polo Beach Club

An interim injunction has been granted Labadi Beach Hotel by the Land Division of the High Court in Accra that restrains Spartan Ives Limited, operators of Polo Beach Club, from encroaching on its property.

The injunction issued on December 19, 2024, follows a legal action by the hotel to reclaim all its encroached lands.

The court has issued clear directives prohibiting Spartan Ives Limited and its associates from:

1. Entering or making use of the 0.54-acre section of the hotel’s property, including its use as a car park, pathway, or event venue.
2. Operating the Polo Beach Club or conducting any events on the hotel’s grounds or adjoining restricted areas.
3. Utilizing the beachfront adjacent to the hotel’s property, in breach of the lease agreement signed on November 27, 1990.

This injunction, valid for 10 days, warns that failure to comply may lead to contempt proceedings against the defendants.

Labadi Beach Hotel has taken this legal action to defend its property and reputation amid claims of land encroachment. Supported by affidavits submitted by the hotel’s management, led by David Eduaful, this move reinforces its commitment to safeguarding its status as Ghana’s premier 5-star beach resort.

Okudzeto Ablakwa who has been at the forefront of the fight against what he describes as State capture under the New Patriotic Party (NPP) government indicated that the injunction is a victory for the people of Ghana who voted massively against the New Patriotic Party government.

He is optimistic that the Labadi Beach Hotel will get back their beachfront from the people who wanted to grab it.
