High court dismisses injunction against KNUST VC, awards GHC9,000 costs against plaintiff

A Kumasi High Court has dismissed an injunction application against the reappointment of Prof Rita Akosua Dickson as the vice chancellor of the Kwame Nkrumah University of Science and Technology (KNUST).

In his lawsuit against the university, and its governing council chairman, the plaintiff, Kofi Ohene Asare argued that the reappointment of the vice chancellor was procedurally flawed.

In court on Tuesday (30 July) His Lordship Justice Frederick Tetteh, sitting at the general jurisdiction of the high court, however, ruled that the plaintiff could not authenticate the purported University’s statutes brought before the court to substantiate his claims.

The judge who further questioned the capacity of the plaintiff to take such an action, ruled that the court was not convinced he was a member of the KNUST alumni. The case was consequently dismissed as deemed frivolous and had no merit.

The court awarded a cost of GHC9000 against the applicant.

Shortly after the verdict Asare subsequently filed an application at the Court of Appeal to overturn the decision of the high court. An attempt to serve the defendants at the court premises turned nearly chaotic.

“I’m dissatisfied with the ruling of the court”, Asare told the media.

“Injunction should be placed on a process which breached their own statutes… They relied on capacity and locus. The issue is a public breach and today we have filed a stay of execution, and we have to wait until a better judgment, or the law is looked at deeply.”

“The defendants will be served today unless they want to run away from service”, he stated.

Meanwhile, university authorities are urging calm urging aggrieved parties to resolve issues against the extension of the VC’s term amicably.

“We are very happy about the outcome of what happened today. It gives us relief, and the university can proceed peacefully. It means the vice chancellor can take office on 1 August and continue to work.”

“The entire university was in court, it’s a big relief for us that this matter has been put to rest. We want to thank the university community for their patience. I want to ask for restraint, let cool heads prevail. All aggrieved persons should come to the university, we’re ready to listen.”

Meanwhile, a staff of the university has filed another suit on a similar account to injunct the reappointment of the vice chancellor.
