Chief Justice is becoming detrimental to our democracy – Sam George

The Member of Parliament(MP) for  Ningo-Prampram Constituency, Sam George has is of the view that the Chief Justice, Justice Gertrude Araba Esaaba Sackey Torkornoo is becoming detrimental to the democracy of the country.

During a panel discussion on TV3’s KeyPoints, Sam George stated that the Chief Justice and the Supreme Court has caused a constitutional crisis in the recent ruling on the vacant seats in parliament.

“The Chief Justice has led us into a constitutional crisis. The Chief Justice is becoming detrimental to our democracy. She is aware that the Supreme Court on several occasions have refused to hear matters where their jurisdiction has been evoked when the constitution is clear. Articles 33 and 91 are clear when it comes to the fundamental human rights” Sam George emphasized.

According to Sam George, some members of the Supreme Court have led themselves to absurdity. He further argued that it is absurd for the Chief justice to be used in such a manner that she will bring the Supreme Court in a position where it will be in conflict with the fundamental human rights of people and the matter of vacant seats.

The MP for Ningo-Prampram also described the actions of the Supreme Court as over stepping its boundaries.

“The Supreme Court is stepping her powers and bordering on Article 296. She is being arbitrary, and capacious and malicious in her use of her power” the Ningo Prampram MP stated.

Sam George further added that the Supreme Court has no supremacy on the parliament of Ghana.

A few days ago, the Supreme Court ruled that the declaration of four parliamentary seats vacant by the Speaker of Parliament was unconstitutional.

The court by a 5-2 majority affirmed the application by Alexander Afenyo-Markin, the Majority Leader of Parliament.

The effect of the court’s decision means that the ruling by the Speaker declaring the four seats vacant was unconstitutional and therefore the four MPs have by law not vacated their seats.
