Mr. Fred Agbenyo, Member of Parliament for the Guan Constituency in the Oti Region, has asserted that the Electoral Commission (EC) of Ghana has no legal authority to determine the outcome of elections once results have been declared.
Speaking during a panel discussion on TV3’s New Day, Mr. Agbenyo emphasized that Ghana’s democratic principles require adherence to constitutional provisions and accused the New Patriotic Party (NPP) of hypocrisy in their recent actions following the elections.
“One of the fundamental problems we face as a nation is the lack of principles and truthfulness,” he remarked.
The MP criticized the NPP for organizing a press conference to contest the results of parliamentary seats lost in certain constituencies during the elections. He questioned their motives, suggesting they were attempting to pressure the EC into taking unconstitutional actions.
“Would the NPP hold a press conference and ask the EC to do something illegal if they were in our position?
What does Article 99 of the Constitution say about election disputes at the constituency level? Which institution has the mandate to determine an election after collation is complete and a winner has been declared?” Mr. Agbenyo asked pointedly.
He further called on the NPP to pursue their grievances through the appropriate legal channels if they were dissatisfied with the declared results, urging them to respect the rule of law.
“Where we stand now, even the Electoral Commission, under the law, has no authority to decide who has won or lost the elections, especially once the results have been declared. If you’re unhappy, head to court,” he advised.
