Lawyer Beatrice Annan, the spokesperson for the John Mahama campaign team has explained the constitution while questioning Hon Alexander Kwamena Afenyo-Markin on his stand.
Beatrice Annan referred to Article 29 Acts 5 and Order 19 Rule 3 subrule 3 of Ci 47 which was used by the NPP’s Afenyo-Markin to petition the court.
Article 29 Act says “In any judicial proceedings in which a disabled person is a party the legal procedure applied shall take his physical and mental condition into account. “
According to Beatrice Annan, this Article used by the NPP is irrelevant to the case on grounds. “Who’s disabled here? Afenyo-Markin, the Speaker of Parliament or Godfred Dame?”.
According to Beatrice, the constitution makes it clear that this particular Article be used for people who are mentally unstable and have physical disability and not otherwise.
It would be recalled that Majority Leader Alexander Afenyo-Markin stated that he expected the Speaker of Parliament to obey the Supreme Court’s decision to delay the execution of the ruling issued yesterday.
This comes after the Supreme Court asked Alban Bagbin to stay his ruling declaring four parliamentary seats vacant.
Parliament has thus been directed to recognize and permit the four Members of Parliament(MPs) to properly represent their constituencies and carry out their official duties.
