Supreme Court: Bagbin declaration of four seats vacant unconstitutional

The Supreme Court ruled today (12 November) against the decision by the Speaker of Parliament, Alban Bagbin, to declare four parliamentary seats vacant in a 5-2 majority.

The suit was brought to the court by the Majority Leader, Alexander Afenyo-Markin.

The seven-member Supreme Court panel, led by Chief Justice Gertrude Torkornoo, is expected to release the detailed reasons for the ruling tomorrow (Wednesday 13 November).

By this judgment, the governing New Patriotic Party remains the Majority in Parliament and the 4 MPs whose seat have been declared are expected to be reinstated.

Background

On 17 October, Speaker Alban Bagbin ruled that the seats of four MPs, previously members of either of the two main political parties but now registered to run as independent candidates in the 7 December election, or vice versa, be declared vacant.

The ruling was prompted by a formal petition from the MP for Tamale South and former Minority Leader, Haruna Iddrisu.

The Speaker’s decision appeared to shift the balance of power in Parliament, with the governing New Patriotic Party (NPP) becoming the minority (with 135 seats in Parliamentt) and the opposition National Democratic Congress (NDC) becoming the majority (with 136 seats) with just two months to go to the December general election.

However, the Supreme Court issued a stay of execution on 18 October, following an ex parte application filed by NPP MPs to block the enforcement of Bagbin’s ruling.
