Calls on Speaker to accept court verdict an indication that rule of law is in crisis – Sulemana Braimah

Executive Director for the Media Foundation of West Africa (MFWA), Sulemana Braimah, is of the strongest opinion that the rule of law is getting into a serious crisis.

His opinion emanates from calls on the Speaker and the National Democratic Congress (NDC) to accept the verdict of the Supreme Court.

To him, if the Rule of Law was at work, there would not have been the need for calls on the Speaker to accept the verdict.

Making his opinion known in a post shared via social media, he said “When the Supreme Court rules and you hear lawyers and the AG say they expect the affected party to comply, then you know rule of law and justice delivery is getting into a serious crisis. This is because, ordinarily, when the Supreme Court rules, non-compliance is not an option”.

The Supreme Court today, November 12, 2024, delivered a landmark verdict on the Speaker’s declaration of some four seats in Parliament vacant.

In a 5-2 decision, Majority Leader Alexander Afenyo Markin’s position on the law was upheld by the court.

Background

It will be remembered that Alexander Afenyo-Markin, leader of the New Patriotic Party (NPP) parliamentary caucus filed a case to challenge Speaker Bagbin’s declaration of four seats vacant.

The core focus of the dispute is Bagbin’s interpretation of the article of the constitution regarding the declaration of vacant seats in Parliament and what the standing orders of the House say when an MP declares his or her seat vacant.

The Supreme Court granted an exparte application to the majority leader, Alexander Afenyo Markin.

The Speaker of Parliament then filed a case to dismiss the exparte applications, an issue that was dismissed by the Supreme Court.
