Vacant Seats: It’s a political case between NDC and NPP –  Martin Kpebu

Private Legal Practitioner, Lawyer Martin Kpebu has described  the current case over the vacant parliamentary seats  at the Supreme Court as not only constitutional but politically inclined

While reacting to the Supreme Court overruling objection on Justice Gaewu sitting on the vacant MPs seat case during an interview on TV3’s Ghana Tonight monitored by MyuNewsGh.com, Lawyer Kpebu stated that the decision to maintain the Judge on the panel was not a good decision.

According to Lawyer Martin Kpebu, the reasons for objecting the removal  of the the Justice does not augur well, emphasizing that although the basis is constitutional, the case at the Supreme Court is purely political and between the opposition National Democratic Congress (NDC) and  governing New Patriotic Party (NPP).

“This case is political. It’s between NDC and NPP. So if you have a member of the justice who is an NPP, you don’t panel him”, Lawyer Kpebu advised

Lawyer Martin Kpebu further expressed concern about the lost in trust of the Supreme Court, arguing that the Afrobarometer showed the the level of trust in the Supreme Court was 65 % in 2012 however, in the new update, it has dropped to 35%.

“Because of this, I thought the court will be mindful and know how to handle the application so as to restore the dignity of parliament” he lamented, stating that he was disappointed over the happenings at the Supreme Court and has expressed worry on the lost in trust for the Supreme Court.

The Supreme Court on Wednesday October 30, 2024 overruled an objection by the Speaker of Parliament seeking the recusal of one of the panel members hearing the case of four seats in Parliament declared vacant by the Speaker.

Counsel for the Speaker, Thaddeus Sory, raised an objection for the recusal of Justice Ernest Yao Gaewu, on the basis that he was a former Parliamentary Candidate on the ticket of the governing New Patriotic Party(NPP).

However, in overruling the objection, the five-member panel, presided over by the Chief Justice, Justice Gertrude Torkornoo, held that recusing a judge on such ground will not advance the administration of justice.
