Electoral commission has no right to decide election outcomes after declaration – Fred Agbenyo

Mr Fred Agbenyo, Member of Parliament for the Guan Constituency in the Oti Region, has asserted that, by law, the Electoral Commission (EC) of Ghana does not possess the authority to determine the winner or loser of an election once results have been declared.

Speaking during a panel discussion on TV3’s New Day, Mr. Agbenyo criticized the country’s general lack of principles and honesty, which he believes undermines the democratic process.

He specifically labelled the New Patriotic Party (NPP) as hypocritical for organizing a press conference to challenge results in constituencies where they lost parliamentary seats.

“Would the NPP hold a press conference to demand that the EC act illegally if they were in our position now?

“What does Article 99 of the Constitution say about election disputes at the constituency level? Which institution in this country is mandated to determine the outcome of an election after collation is complete and a winner has been declared?” Mr. Agbenyo questioned.

He emphasized that the proper avenue for addressing electoral grievances is the courts, urging the NPP to seek redress through legal channels rather than public agitation.

“At this stage, even the Electoral Commission, under the law, has no right to determine who has won or lost an election once the results have been declared,” he stated.

Mr. Agbenyo’s remarks come amidst ongoing debates over parliamentary results in certain constituencies following the recent elections, highlighting the need for adherence to constitutional procedures in resolving electoral disputes.
